The Free Press vs. National Security: A False Choice? with Gary Pruitt
(Visit: http://www.uctv.tv/) AP President and CEO Gary Pruitt argues that a free and independent press is fundamental to a functioning democracy. It differentiates democracy from dictatorship; separates a free society from tyranny. Governments who try to set up a situation where citizens think they must choose between a free press and security are making a mistake that will ultimately weaken, not strengthen them. It's not a real choice. It's a false choice. Recorded on 10/30/2013. Series: "Richard and Rhoda Goldman School of Public Policy at UC Berkeley" [1/2014] [Public Affairs] [Show ID: 25945]

Assange’s lawyer, Jennifer Robinson, says the judges were receptive to their arguments that Assange could face the death penalty in the U.S. and that an extradition would set a dangerous precedent for press freedom. “If Julian is extradited and goes on trial under the Espionage Act, this is a case which is going to set precedent which criminalizes journalistic activity and will be used against the rest of the media.” A ruling in the case is not expected until next month at the earliest.

What are the First Amendment rights of press in the context of criminal investigations, and when national security is at issue? In the modern, digital age, is there even agreement on who qualifies as press? Should institutional or traditional press have greater rights over non-traditional media, including bloggers? What are the rights of media to publish material leaked from the government? Does the answer change if the media solicited the material or otherwise participated in the leak? What are the policy and legal considerations when it comes to a national media shield law? These and other questions will be addressed by our panel of experts.

Times Free Press Response to D.A. General Pinkston's Remarks on VRI Article%

Hamilton County District Attorney Neil Pinkson and the Times Free Press newspaper are clashing about Pinkston's role in the Violence Reduction Initiative, or VRI.
Pinkston says he has made a promise to prosecute those gang affiliated offenders as harshly as possible. He says he can live up to that promise.
The TFP says Pinkston " appears to hesitant to buy into his role" in the VRI.
Editor and Director of the Times Free Press Alison Gerber spoke to NewsChannel 9 about the article at the center of the dispute.
The story's headline reads "District Attorney Neal Pinkston says he won't give VRI cases priority."
"It's clear and accurate," Gerber said. "[Pinkston] said over and over on the interview that they don't treat these cases any different, which is the whole point of the story."
The Times Free Press gave us a copy of reporter Shelly Badbury's recording of the TFP's interview with Neil Pinkston and his office.
During the interview, you can hear one of the prosecutors say, "We can't give anybody increased punishment just because they were arrested as part of the VRI."
Gerber says, "The program is 19 months in and it seems odd that Mr. Pinkston is now saying that he doesn't treat the cases differently because this is a program aimed toward singling them out."
Pinkston says he's never given special attention to VRI cases, because he's not supposed to.
"We can live up to punishing people within the law, and what the law says they can reach," Pinkston said. "We argue that all the time, but we cant create stiffer penalties than exist."
Last week Chattanooga Police Chief Fred Fletcher was interviewed by the paper.
Pinkston says Fletcher then called him to ensure the goals of CPD and the DA's office align.
Pinkston says he told Fletcher that his office was fully on board with the VRI.
"He said just so you know it looks like they are trying to create a division between the police department and us," Pinkston said.
In the TFP's interview with the DA's office, prosecutors explain they often get more evidence or information from police about a suspect if the suspect is a part of the VRI. That additional evidence can lead to a tougher prosecution by his office.
However, Pinkston's office says they can't do anything special to seek higher punishment for someone just because they are in the VRI.
"We can ask the judge to go to the high end of the range," one prosecutor said on the tape. "But the range is the range. The law doesn't accommodate VRI."
We asked Gerber if her reporters had a complaint or complainant for the story they printed on Sunday. She said, "No they didn't. they were doing a story on the VRI sentencing and the prosecutions and where they were, it came up in the interview it was raised up by him that he doesn't treat these cases differently."
Pinkston also claims reporter Shelly Bradbury said, during the interview that she, "makes up facts."
Gerber says that statement was a joke taken out of context.
Bradbury can be heard on the recording saying, I make up facts all the time. Just kidding. Just kidding. That was a joke."
Pinkston says he didn't take anything in their conversation as a joke.
